WholeSoft Market connects sellers of innovative Enterprise software with relevant business leaders in accounts. For doing so, WholeSoft Market analyzes, exploits, and deals with business connections. We help our members map with other members. This relationship information is personal and valuable to our members and requires a privacy policy that holds the integrity and protection of this information to the highest standard.

WholeSoft Market is committed to respecting the privacy of every person who visits, registers with, or subscribes to our platform, website, and other products or services, or about whom we otherwise collect personal data and respects the privacy rights of our stakeholders (our members and their relationship data, our partners, our customers, and our employees) and is committed to protecting all personal information in our possession or control. 

 

We will process your data for the following lawful purposes: with your consent; where it is necessary for us to perform a contract we have with you, or because you have asked us to take specific steps before entering into a contract (for example, when you register for any of our services on our platform); because the processing is necessary for us to comply with the law; or where the processing is necessary for our legitimate interests or the legitimate interests of a third party.  We review the bases for our processing decisions carefully and you can object to these activities at any time (see the “Your Rights” section of this Privacy Notice).

 

This Privacy Policy complements our Rules & Policies document. If you do not agree with this Privacy Policy or any part of it, you should not access this platform or use our services. 

Collecting & processing your personal data

WholeSoft Market is committed to providing its innovative service while respecting the privacy of everyone involved and complying with any applicable privacy and data protection laws.

Our primary goal in collecting personal data from you is to give you a relevant customized experience of our products and services.

We are committed to providing our stakeholders with the most useful and accurate database possible and have implemented internal measures for accuracy and relevancy purposes. We implement processes to cross-check and verify the accuracy of the data in the WholeSoft Market Platform and do not store personal and private contact details to the extent reasonably possible.

 

WholeSoft Market only collects data to the extent necessary to its business purpose and does not collect sensitive data related to health, religious beliefs, political opinions, or ethnicity.

 

When you register with our website and/or sign up on our platform, we ask you to provide your name, email address, job title, and details relevant to your business network.

 

WholeSoft Market thus collects and processes your personal data and such other personal data of others you may provide us, to deliver the services you have agreed on. The legal basis for this processing is consent or legitimate interest.   

 

We use algorithmic software technology to help us improve the quality and relevance of our services.

 

Additionally, we may receive your personal data from other sources, such as public databases, and other third parties, like our members for example, for use in accordance with this Privacy Notice.

 

This personal data may be shared within the WSM platform, and you understand that the use of the information we share will be governed by our privacy policy.

 

WholeSoft Market also uses your personal data to inform you of other products or services available from WholeSoft Market and its partners. WholeSoft Market may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered by WholeSoft Market.

 

We do not sell any information shared with us by our members, partners, or customers.

 

Certain information is collected by most browsers or automatically through your devices, such as your Media Access Control (MAC) address, computer type, screen resolution, operating system name and version, device manufacturer and model, language, and Internet browser type and version.  We use this information to ensure that our services function properly.

 

Your IP address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider.  An IP address may be logged automatically in our server log files whenever you access our services, along with the time of the visit and the pages visited.  Collecting IP addresses is done automatically by many websites, applications, and other services.  We use IP addresses for purposes such as calculating usage levels, diagnosing server problems, and administering our services.  We may also derive your approximate location from your IP address.

 

If WholeSoft Market is sold or sells its assets or is acquired by a third party, then personal data about its customers will be acquired by that third party. A transfer of your personal data in these circumstances would be necessary so that the services you have contracted for can still be delivered, or so that you can continue to enjoy the benefits of our products and services. You will receive notice if a new controller assumes responsibility for your personal data.

Additional third-party disclosures

  • To third-party partners who help us by providing services such as technology, advisory, or other services. These third parties will be bound by WholeSoft Market’s privacy policy and may only process personal data to provide those services to us.

  • Where we are required by law or regulation to do so. In each case we will seek, where practicable, to minimize the amount of data that is disclosed.

  • If required to protect the rights and interests of other users and/or WholeSoft Market, or as otherwise set out in our Rules & Policies. This may include exchanging information with other companies and organizations for the purposes of fraud protection.

Email tracking

 

We may include small pixel tags (small image files) within the emails we send you in order to determine whether our emails are opened and/or whether the hyperlinks inside our emails are clicked through. We may also collect browser, location, and the device used to engage with our email communications. This information allows us to better understand whether we are meeting our users’ needs and how we can improve our communications.  No other information is collected. You can opt-out of receiving our direct marketing emails either by following the instructions in each email, writing to WholeSoft Market’s Data Protection Officer: contact@wholesoftmarket.com or by contacting us (see the “How to exercise your rights” section of this Privacy Notice).

Retention Periods

This Section sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.

Notwithstanding the other provisions of this Section, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

Your Rights

We have summarized here the rights that you have under data protection law. Some of the rights are complex, and not all details have been included in our summaries. Accordingly, you should read the relevant laws and guidance from the regulatory authorities for a full explanation of these rights.

 

You may request access to any personal data of yours for which WholeSoft Market is responsible as controller.  Unless there are legal or regulatory reasons for not doing so, we will confirm whether we process any of your personal data and if we do, we will provide you with the following information:

  • the purposes of the processing,

  • the categories of personal data,

  • any recipients of your personal data,

  • the applicable retention period,

  • and the data source.

 

Copies of your personal data will be made available to you in a structured, machine-readable format or as otherwise agreed between us. 

You may also request that we transfer the personal data that you have submitted to us, to another controller, where it is technically feasible for us to do so.

You have the right to request that WholeSoft Market rectify any errors in the personal data that we process. In some circumstances, you may also be able to ask for the erasure of personal data, and/or request that the processing of your personal data be restricted.  You may also object to the processing of your personal data for sales or marketing purposes.

If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. When you exercise your rights, we may seek to verify your identity. If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. If you are an authorized agent seeking to make a request, please contact us. We will not discriminate against you for exercising your rights.

 

Protecting Your Data

WholeSoft Market endeavors to keep your personal data secure and takes appropriate technical and organizational measures to protect your personal data from loss, unauthorized use, disclosure, or destruction. Although we do our best to protect your personal data, we cannot guarantee that any transmission of data is without risk.

All our employees, contractors, and data processors (i.e. those third parties that process personal data on our behalf) are required to keep such data confidential and not to use it for any purpose other than the performance of services we have requested.

We are headquartered in France and, while our Data is stored on Amazon Web Services in the United States of America, many of our Data processing activities are carried out from other countries including by staff operating in the European Economic Area or in India who work for us or for one of our service providers or partners.

Changes to this Privacy Notice

We reserve the right, at any time, to add to, change, update, or modify this Privacy Notice so please review it frequently. If we make a material change to our Privacy Notice, then we will revise the date at the bottom of this Privacy Notice and, in some cases, we may notify you by email or by posting a notice on our website. In all cases, the use of the information we collect is subject to the Privacy Notice that is in effect at the time such information is collected. If you do not agree with any changes or modifications to the Privacy Notice, please do not continue using our products and services. You will be deemed to have consented to any modification of the Privacy Notice when you use our products and services after the effective date of the modification.
